By accessing this website, purchasing a product, downloading digital content, or otherwise using ShopJamiePhoto.com, you agree to these Terms of Service.
If you do not agree to these Terms, please do not use the website or purchase products through it.

Shop Jamie Photo is an independent creative business offering original hand embroidery artwork, Stick n Stitch products, embroidery patterns, educational materials, books, tutorials, and related creative products.

Shop Jamie Photo creates original artwork inspired by subjects, themes, characters, stories, objects, places, media, and other things that Jamie Photo enjoys and finds creatively meaningful.
Shop Jamie Photo does not claim to own, control, or hold copyrights, trademarks, or other intellectual property rights in third-party properties, brands, characters, franchises, or other intellectual property that may inspire or relate to any Shop Jamie Photo artwork.
Any references to, or similarities with, third-party properties are intended to reflect artistic inspiration, commentary, appreciation, or creative interpretation and do not necessarily indicate ownership, affiliation, sponsorship, endorsement, or authorization by the owners of those properties.
Shop Jamie Photo does not represent that any artwork is officially licensed, endorsed, sponsored, or approved by the owners of third-party intellectual property unless expressly stated otherwise.
Shop Jamie Photo is not responsible for third-party intellectual property rights, claims, disputes, or enforcement actions relating to third-party properties that may be referenced, suggested, or reflected in artwork or design motifs.
Shop Jamie Photo is also not responsible for similarities between its artwork and third-party designs, characters, symbols, themes, motifs, or other intellectual property where those similarities arise from shared inspiration, common artistic elements, coincidence, interpretation, or independent creation.
Shop Jamie Photo retains rights in the original artwork, photographs, written content, tutorials, graphics, branding, website content, and other materials that Shop Jamie Photo creates or is authorized to use.
Purchasing a product does not transfer ownership of Shop Jamie Photo's original artwork, design files, photographs, written content, or other protected materials to the purchaser.
All rights not expressly granted in these Terms are reserved by Shop Jamie Photo.
5. Personal Use License for Artwork and Patterns
All artwork and embroidery patterns purchased or downloaded from Shop Jamie Photo are licensed for personal, noncommercial use only unless Shop Jamie Photo provides separate written permission.
You may use a purchased pattern or design to create embroidery for your own personal enjoyment or as a personal gift.
You may not sublicense, resell, share, transfer, distribute, redistribute, reproduce for distribution, publish, upload, sell, or otherwise provide the artwork or pattern to another person.
You may not modify, adapt, trace, redraw, recolor, digitize, vectorize, convert, or create derivative pattern files from Shop Jamie Photo artwork for redistribution or commercial use.
You may not use Shop Jamie Photo artwork or patterns to create products for sale unless you have received express written commercial licensing permission from Shop Jamie Photo.
You may not include Shop Jamie Photo artwork or patterns in kits, classes, memberships, subscription products, pattern bundles, downloadable collections, print-on-demand products, machine embroidery files, or other commercial products.
You may not upload Shop Jamie Photo artwork or patterns to artificial intelligence systems, image generators, training datasets, design generators, or similar automated systems for the purpose of training, reproducing, adapting, or generating derivative content.
The license granted to you is personal, limited, revocable, nonexclusive, and nontransferable.
6. Digital Downloads
Certain products may be delivered digitally.
To access digital downloads, you must have access to software or a device capable of opening and reading PDF files.
If the product is intended to be printed, you must also have access to a suitable home computer and printer or another compatible printing method.
If you do not have printing facilities, some patterns may be viewed or traced directly from a compatible iPad, tablet, or similar device where appropriate.
It is your responsibility to confirm that you have compatible software, hardware, devices, and printing capabilities before purchasing a digital product.
Shop Jamie Photo is not responsible for incompatibility caused by your device, printer, software, operating system, application, or other equipment.
Digital purchases grant you access to the file and the limited personal use license described in these Terms.
They do not transfer ownership of Shop Jamie Photo's original artwork, design files, or other intellectual property.
7. Digital Download Delivery
Digital products may be delivered through Squarespace or another authorized digital delivery platform.
Squarespace currently provides download links for digital products after purchase, and those links may expire and be reissued according to Squarespace's delivery system.
You are responsible for providing a valid email address and for downloading and safely storing purchased files.
You may not share a download link with another person.
8. Digital Product Refunds
Because digital products can generally be accessed shortly after purchase, digital purchases are normally final once the digital content has been accessed or downloaded, except where applicable law requires otherwise.
Nothing in these Terms removes or limits any consumer rights that cannot legally be waived.
For customers located in the European Union or another jurisdiction with mandatory withdrawal rights, additional consumer protections may apply.
Under European Union consumer law, a customer may lose the right to withdraw from a digital content purchase once digital performance begins only where the legally required prior consent, acknowledgment, and confirmation requirements have been satisfied.
Where required, Shop Jamie Photo will honor applicable statutory cancellation, refund, conformity, and consumer rights.
9. Physical Products
Shop Jamie Photo may sell physical embroidery products, including Stick n Stitch packs and other handmade or artist-produced goods.
Product photographs are intended to represent the item as accurately as reasonably possible.
Because products may be handmade, assembled, printed, cut, packaged, or finished by hand, minor differences between individual products may occur.
These variations are not necessarily defects.
Colors may also appear differently depending on your screen, device, lighting, printer, fabric, thread, or other materials.
10. Handmade Artwork
Please be aware that each Shop Jamie Photo pattern begins with hand-drawn artwork.
Hand-drawn artwork naturally includes small variations and individual characteristics.
These details are part of the handmade nature and character of the designs rather than evidence that every line must appear mechanically perfect or identical.
Thank you for respecting the time, care, and creative effort that goes into creating each Shop Jamie Photo design.
11. Orders
Submitting an order does not guarantee acceptance of that order.
Shop Jamie Photo reserves the right to refuse or cancel an order for legitimate reasons, including suspected fraud, pricing errors, inventory errors, payment problems, incorrect product information, technical errors, or suspected violation of these Terms.
If payment has already been collected for an order that Shop Jamie Photo cancels, the appropriate amount will be refunded according to the payment provider's procedures.
12. Prices
Prices are displayed in the currency shown at checkout.
Shop Jamie Photo may change prices at any time.
A price change will not normally affect an order that has already been accepted and paid, except where there has been an obvious pricing or technical error.
Taxes, duties, shipping charges, and other fees may apply depending on the customer's location and the nature of the purchase.
13. Payment
Payments may be processed through Squarespace and third-party payment processors.
Shop Jamie Photo does not control the independent terms, availability, processing times, or security practices of those payment providers.
By submitting payment information, you represent that you are authorized to use the selected payment method.
14. Shipping
Physical orders are shipped using the shipping method available or selected during checkout.
Any shipping or delivery estimate is an estimate rather than a guarantee unless applicable law states otherwise.
Shop Jamie Photo is not responsible for delays caused by postal carriers, customs authorities, weather, natural disasters, transportation disruptions, incorrect customer addresses, or events reasonably outside the business's control.
Customers are responsible for entering an accurate and complete shipping address.
If an order is returned because an incorrect or incomplete address was provided, additional shipping charges may apply before the order is sent again.
15. International Orders
International customers are responsible for any customs charges, import duties, taxes, brokerage fees, or other charges imposed by their country unless applicable law or the checkout process provides otherwise.
Customs processing may delay delivery.
Shop Jamie Photo is not responsible for delays caused by customs authorities.

Results may vary depending on materials, tools, experience, fabric, thread, technique, and other factors.
You are responsible for safely using needles, scissors, irons, tools, adhesives, chemicals, craft supplies, and other materials.
Children should use appropriate craft tools only with suitable adult supervision.
19. Third-Party Websites and Services
ShopJamiePhoto.com may contain links to third-party websites and services including Etsy, Faire, Patreon, YouTube, Instagram, Pinterest, TikTok, payment processors, book retailers, shipping carriers, and other platforms.

This restriction does not prohibit ordinary search engine indexing that respects applicable technical controls and law.
25. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the website and its content are provided on an as-available basis.
Shop Jamie Photo makes no guarantee that the website will always be uninterrupted, completely error-free, or available at every moment.
Nothing in this section excludes warranties or consumer protections that cannot legally be excluded.
26. Limitation of Liability
